Often, in order to participate in such tenders and make deliveries under them, it is necessary to issue a number of documents confirming the corresponding percentage of ad valorem share (localization) of production.

Such documents confirming the origin of goods include: a certificate of origin, an expert report, and a conclusion of the Ministry of Industry and Trade.

Expert report

Examination report – a document issued by the authorized Chamber of Commerce and Industry on the basis of an application and documents provided by the applicant to confirm the percentage of localization (ad valorem share) of production.

The applicant may be a resident of the Russian Federation who is interested in participating in municipal and state tenders and contracts, one of the conditions of which is to provide a document confirming the ad valorem share of production.

The certificate of expertise may be issued for goods specified in items 15-23, 24-27 and 29-42 of the list provided for in the annex to the decree of the Government of the Russian Federation "On establishing a ban on the admission of certain types of engineering goods originating from foreign countries for the purpose of procurement to meet state and municipal needs" of July 14 2014 No. 656, which must be manufactured in accordance with the requirements set out in the note to the List, including goods manufactured on the basis of basic vehicles that were manufactured in accordance with the requirements of the specified decree of the Government of the Russian Federation.

At the same time, the goods specified in items 15-23 of the List or basic vehicles for the production of these goods, in addition to meeting the specified requirements, must be:

- produced by persons (business entities) listed in the List of business Entities engaged in the production of motor vehicles in 2010 using the concept of "industrial assembly" in accordance with the criteria specified in paragraph 7.1.1 of the decision of the Customs Union Commission of November 27, 2009 No. 130, which was approved by the Decision of the Customs Union Commission of January 27, 2010 No. 169 "On granting Tariff privileges for the Payment of Import Customs Duties to Economic Entities Engaged in the production of motor Vehicles"

- carried out in accordance with paragraph 6 of paragraph 2 of Article 10 of the Agreement of June 18, 2010, by persons whose state registration was carried out in the Kaliningrad Region and who, as of April 1, 2006, were operating on the basis of Federal Law of the Russian Federation No. 13-FZ of January 22, 1996 "On the Special Economic Zone in the Kaliningrad Region". Kaliningrad region".

Conclusion of the Ministry of Industry and Trade

The conclusion on confirming the production of industrial products on the territory of the Russian Federation is issued by the Ministry of Industry and Trade of the Russian Federation in accordance with the Rules for issuing an opinion on Confirming the Production of Industrial Products on the Territory of the Russian Federation, approved by Decree of the Government of the Russian Federation No. 719 of July 17, 2015.

Resolution No. 719 established that the criteria for confirming the production of industrial products on the territory of the Russian Federation are::

1 Criterion: Existence of a special investment contract concluded by the investor and the Russian Federation or the Russian Federation and a subject of the Russian Federation and / or a municipal entity (information on concluded contracts)

2 Criterion: Availability of an expert report of the Chamber of Commerce and Industry of the Russian Federation on the conformity of manufactured industrial products with the requirements of

3 Criterion: Availability of a certificate of origin of goods (products), according to which the Russian Federation is the country of origin of goods (products).

Goods not included in the Annex to Resolution No. 719 are subject to the requirements set out in Annex 1 to the Rules for Determining the Country of Origin of Goods in the Commonwealth of Independent States, which are an integral part of the Agreement on the Rules for Determining the Country of Origin of Goods in the Commonwealth of Independent States of November 20, 2009.

Belarus, Azerbaijan, Georgia, Armenia, Moldova, Kazakhstan, Tajikistan, Kyrgyzstan, Turkmenistan, South Ossetia and Abkhazia are members of the Free Trade Zone.

Ukraine has been excluded from this list since January 2016, and instead of the ST-1 certificate, a general form of document is issued for this country.

This form of certificate is established in accordance with the Vietnam Free Trade Area Agreement.
